Fox News senior judicial analyst Andrew Napolitano is criticizing President Obama for seeking congressional authorization for a military strike on Syria after previously criticizing Obama for not seeking congressional authorization for a military strike on Libya.
Obama said he would seek Congressional authorization for a military strike on Syria during a September 1 speech. He stated that he believed the nation's power is rooted "in our example as a government of the people, by the people, and for the people," adding: "[W]hile I believe I have the authority to carry out this military action without specific congressional authorization, I know that the country will be stronger if we take this course, and our actions will be even more effective. We should have this debate, because the issues are too big for business as usual."
Napolitano criticized Obama for seeking legislative approval of military action in Syria during a September 3 appearance on Fox & Friends, calling his actions "mystifying legally why the president is asking Congress for authority to do something that it has already given him authority to do," citing the executive power granted under the War Powers Act to use U.S. forces in some circumstances for 90 days without congressional authorization. Napolitano and co-host Steve Doocy agreed this indicated Obama was treating Syria as a political issue.
While Napolitano is now criticizing Obama's effort to seek congressional authorization for a military strike, he previously criticized Obama for preparing a military strike without that authorization. In March 2011, when President Obama was considering military action against Libya without seeking congressional authorization, Napolitano warned that Obama could use "a terrible law called the War Powers Act," asking Sen. Mike Lee whether Obama was "planning to do something like that, whether the American people or the Congress wants it or not? Even though the Constitution says only Congress shall declare war?"

NAPOLITANO: Senator Lee, it's interesting that Senator Paul said that he's reluctant to vote. You know as well as I that under a terrible law called the War Powers Act, the president can commit to us a land war, or an air war, whatever he wants to do, for 90 days and then renew it for another 90 days and there's nothing the Congress can do about it.
Is he planning to do something like that, whether the American people, whether the Congress wants it or not? Even though the Constitution says only Congress shall declare war?
When Fox host and senior judicial analyst Andrew Napolitano appeared on "Conspiracy King" Alex Jones' radio show last week and announced that 9-11 "couldn't possibly have been done the way the government told us," he seemingly put his employer in a difficult position.
By Fox News standards, you don't even have to personally espouse trutherism in order to be attacked. As evidenced by the network's attacks on Park51 Imam Feisal Abdul Rauf because he supposedly "Pals Around With Truthers," if you used to work with someone who later became a truther, you are a fair target for criticism (even if you yourself have emphatically stated that 9-11 was carried out by extremist Muslims.)
Before we discuss Fox News' astounding non-response to Napolitano's comments, it's important to point out that he is not just a random Fox contributor who pops up for occasional analysis -- Napolitano is undoubtedly a rising star at the network.
After several years as an analyst at Fox News, Napolitano was handed a weekend show earlier this year at the Fox News Junior Varsity team, more commonly known as Fox Business. His show -- which was exclusive to FoxNews.com before being bumped up to FBN -- was recently moved to the prime 8pm weekday slot on the network. Napolitano also continues to regularly appear on Fox News to provide input on a wide range of issues.
He has been the recipient of effusive praise from some of Fox's most prominent on-air personalities as well. When Justice David Souter announced he was retiring from the Supreme Court in 2009, Fox & Friends host Steve Doocy joked that he "would like to officially nominate" Napolitano for the position.
Earlier this year, Glenn Beck called Napolitano "one of the sharpest men I know" and told him that "if I were God of the Universe, you'd be my Supreme Court justice."
In a case of remarkably poor timing, the morning after Napolitano's appearance on Jones' radio show -- but before his offensive comments had come to light -- Beck announced on his radio show that Napolitano "used to" piss him off when Beck was "naïve and foolish" in 2002. Beck said that Napolitano has actually "turned out to be right on almost everything," is "one of the most decent men" he knows, and that if Beck "ever had to go to battle" and "needed people behind" him, Napolitano would be "one of the first" people Beck would call.
Beck apparently thinks so highly of Napolitano that he frequently lets Napolitano serve as his guest host when he takes days off.
While Beck reveres Napolitano, he absolutely loathes anyone even tangentially associated with the 9-11 Truth movement. Last year, Beck repeatedly attacked former White House adviser Van Jones after his name appeared on a 9-11 Truth petition (Jones has stated that he believes Al-Qaeda caused the attacks and that he was lied to about the petition, which was "something that I never saw and never signed onto"). Beck also called for an "investigation" of Imam Rauf over the fact that his former colleague eventually became a truther.
On the March 22, 2007, edition of his CNN Headline News program (accessed via Nexis), Beck spent a large portion of his show debunking 9-11 conspiracy theories with Michael Shermer of Skeptic magazine and James Meigs, the editor-in-chief of Popular Mechanics.
During the show, Beck called 9-11 conspiracy theorists "nut jobs," "idiots," "dangerous," "anarchists," "the kind of group that a Timothy McVeigh would come from," and "exactly the kind of people who want to rock this nation's foundation, tear us apart and plant the seeds of dissatisfaction in all of us." Teasing the segment, he said "could these nut jobs also pose a very real threat? You'd better believe it."
Well, what does Beck think of the fact that "one of the sharpest" men he knows -- the man he hands the keys of his show over to when he is on vacation -- has revealed himself as a dangerous nut job idiot who could pose a very real threat?
Beck's cowardly silence about Napolitano is in keeping with the rest of his network. Despite criticism from 9-11 victims' families and even numerous conservatives, both Fox News and Napolitano have refused to address the controversy on-air or off.
And, for the record, Napolitano's promotion of 9-11 conspiracy theories on Jones' show was no accident -- he previously made similar remarks on a Tennessee radio show in May.
During a February 2009 appearance on Fox & Friends, Red Eye host Greg Gutfeld ranted against 9-11 conspiracy theorists and said, "People are too scared to confront 9-11 conspiracies because it's like the crazy guy on the subway. You don't want to make eye contact. But sooner or later you've gotta make eye contact and tell that guy to get lost." Apparently, when the "crazy guy on the subway" is actually your coworker, at no point do you have to "tell that guy to get lost."
As always, it seems like there is almost nothing a Fox employee can do to warrant getting reprimanded by the network. This entire episode confirms once and for all that loyalty to Fox News trumps all.
And, this being Fox News, Napolitano's trutherism was not the network's only foray into promoting conspiracy theories this week.
On Monday's edition of Fox & Friends, the crew hosted former Republican congressman and current NewsMax columnist John LeBoutillier to promote his book, The Obama Identity. During the segment, LeBoutillier pushed the idea that Obama was actually born in Kenya, without any forceful rebuttal by hosts Steve Doocy or Brian Kilmeade. Both LeBoutillier and the Fox & Friends crew tried to suggest that his "fiction" book may actually have basis in reality. The chyron during the segment was "Fact or Fiction? 'Obama Identity' a fictional tale of reality."
So what is this "fictional tale of reality" about? Well, it promotes numerous conspiracy theories about Obama, and, in the words of Media Matters' Oliver Willis, it not only reads like it was written "in the language of a hormonal teenager," but also apparently features President Obama's foreskin as a major plot device.
And who is John LeBoutillier? Well, before his current occupation as a professional peddler of insane and discredited conspiracy theories about President Obama, LeBoutillier spent the 90s pushingoutlandish conspiracies about then-President Clinton and his family -- including suggesting Clinton killed Deputy White House Counsel Vince Foster and had an account "in the Cayman Islands, which is a refuge for drug money."
As we documented, Fox's promotion of LeBoutillier's book and Napolitano's trutherism are in character for the network, which has increasingly become a welcoming place for conspiracy theorists.
Earlier this week, discussing Napolitano, Hot Air's Allahpundit asked, "Precisely how many of these people does Fox have on staff? Am I going to open a newspaper tomorrow and find out that Megyn Kelly or Julie Banderas thinks the Pentagon was hit by a missile?" Based on the network's steadfast refusal to comment on the story, it's impossible to answer that question -- to the serious detriment of people at Fox who care about their credibility.
What does it say about Fox hosts like Sean Hannity, Bill O'Reilly, Glenn Beck, Greta Van Susteren and Mike Huckabee -- many of whom have repeatedly and explicitly condemned truthers in the past -- that they are unwilling to speak out now that their coworker has revealed himself as one?
Are Fox's "news" anchors -- people like Chris Wallace, Bret Baier, and Megyn Kelly -- okay with the fact that their bosses refuse to condemn someone who promotes 9-11 conspiracy theories?
And how about Fox personalities like Sarah Palin, Newt Gingrich, Dick Morris, Michelle Malkin, and Laura Ingraham? Are they comfortable being employed by a network that refuses to condemn a truther employee and hosts people like John LeBoutillier to suggest the president was born in Kenya?
Based on their (apparently now discarded) standards, the entire Fox staff's association with a truther like Napolitano should make them a ripe target for criticism.
Is there anyone at Fox whose fealty to the network is outweighed by standards of decency?
Yesterday, Fox Business host and Fox News senior judicial analyst Andrew Napolitano revealed himself as a believer in the conspiracy theory that the government is lying about the attacks on September 11. Speaking on a leading conspiracy show, Napolitano said that it's "hard for me to believe that" World Trade Center building 7 "came down by itself" -- a central tenet of 9-11 conspiracy theories -- and claimed that "twenty years from now, people will look at 9-11 the way we look at the assassination of JFK today. It couldn't possibly have been done the way the government told us."
Napolitano made his remarks on the radio show of Alex Jones, who is widely viewed as the leader of the conspiracy theory that the 9-11 attacks were an inside job. Jones describes himself as "one of the very first founding fathers of the 9-11 Truth Movement" and his website features a section for 9-11 conspiracy theories.
Popular Mechanics notes, "Conspiracy theorists have long claimed that explosives downed World Trade Center 7, north of the Twin Towers." The publication, which frequently debunks 9-11 conspiracy theories, added that a "report from the National Institute of Standards and Technology (NIST) conclusively rebuts those claims. Fire alone brought down the building, the report concludes, pointing to thermal expansion of key structural members as the culprit. The report also raises concerns that other large buildings might be more vulnerable to fire-induced structural failure than previously thought."
The New York Timesnoted in 2008 that "the collapse of 7 World Trade Center -- home at the time to branch offices of the Central Intelligence Agency, the Secret Service and the Giuliani administration's emergency operations center -- is cited in hundreds of Web sites and books as perhaps the most compelling evidence that an insider secretly planted explosives, intentionally destroying the tower."
Napolitano has long appeared on the program of Jones, who has been criticized by the Southern Poverty Law Center and the Anti-Defamation League, among others, for outlandish conspiracy theories. However, as Jones himself indicated, this appears to be the first time Jones has discussed his pet cause with Napolitano on-air.
As Media Mattershasdocumented, Napolitano's previous Jones appearances have been marked with conspiracy theories about the government and the "New World Order." For instance, Napolitano and Jones have agreed that Obama will "start a wider global war" to "be a prince," and discussed whether a powerful banking cartel linked to "world government" would "collapse the economy" and use that "as an excuse for martial law." Napolitano also told Jones of Texas secession: "That time has come. That may actually happen" because of the actions of the government.
Jones and Napolitano appear to have a close relationship and regularly praise each other.
Napolitano has previously hosted Jones on his Freedom Watch program when it was on FoxNews.com. It now airs daily on Fox Business - a development Jones repeatedly cheered during the interview. Napolitano has promised Jones that he will host him on his Fox Business program.
Napolitano has dabbled in 9-11 Truth discussion before. In March, while still on FoxNews.com, Napolitano hosted truther Jesse Ventura, who was given an unchallenged platform to push 9-11 conspiracy theories. At the conclusion of that interview, Napolitano wondered if "someday we will look on 9-11 the way we look on the JFK assassination today, that is, where people who question the government's involvement will be mainstreamed, rather than looked upon as an extremist fringe." Napolitano also hosted Ventura in October on Fox Business; during the interview, Ventura said he was investigating the "alleged Pentagon plane" attack, to which Napolitano replied, "we'll be watching."
Napolitano and Jones' discussion referenced a segment about WTC building 7 by Fox News host Geraldo Rivera, who hosted a group of family members of 9-11 victims asking the "NYC city council to investigate" the official account about building 7. Rivera, who has been outspoken against 9-11 conspiracy theories, said at the conclusion that he was "much more open minded" about 9-11 questions because of the involvement of 9-11 families and architects and engineers.
Napolitano later discussed the segment with Geraldo on his Fox Business program. Asked if he doubted the official conclusion about building 7, Geraldo said: "I think that it is highly unlikely that our government would do anything nefarious on a scale of this epic nature. However, the building does appear to come down in a way that is reminiscent of a controlled demolition."
Napolitano's belief in 9-11 conspiracy theories may make things awkward with his Fox News colleagues - especially Glenn Beck -- who havedenounced 9-11 conspiracy theories and those associating themselves with anyone making them.
The following is Jones' discussion with Napolitano about 9-11:
JONES: OK finally, man because I've never raised this with you, because it's a subject I just leave alone with folks because I don't want to cause people problems. But you brought it up with Geraldo Rivera, who says he is concerned about building 7, and I want to put the question you put to him to you. I mean, what do you think of Geraldo Rivera coming out -- what do you think of 7?
NAPOLITANO: It's hard for me to believe that it came down by itself. I was gratified to see Geraldo Rivera investigating it. I am gratified to see that people across the board are interested.
I think twenty years from now, people will look at 9-11 the way we look at the assassination of JFK today. It couldn't possibly have been done the way the government told us.
JONES: Well, I want to tell you this. You've got a lot of courage, Judge, and so does Geraldo Rivera. I don't agree with him on some of his more liberal political views, but I do resonate with his courage, and I resonate with yours, and I already had the highest respect for you, but now the thermometer just broke. And the mercury -- geysering out of it right now. Judge, you are a great American, and I just can't wait till your show is number one on Fox Business, when you're on regular Fox full time, because no army can stop an idea whose time has come.
After the interview, Jones praised "awesome" Napolitano for his 9-11 Truth views and criticized the "George Soros publications" who would "persecute" Napolitano:
If tea party darling Michele Bachmann gets her way, conservative broadcaster Sean Hannity, Fox legal analyst Andrew Napolitano and David Barton, a Christian evangelist who has said church-state separation is “a myth,” will make up the faculty roster when the first classes of her new constitutional conservative caucus convene in the next Congress. . . .
“Professor Barton” is a regular lecturer at [Glenn] Beck’s “university.” He has a bachelor’s degree in Christian education from Oral Roberts University and is best known for his conservative group WallBuilders, which teaches that America was founded as a Christian nation.
“Scholars such as David Barton, members of the media who cherish [the founding] principles such as Sean Hannity, honorable commentators such as Judge Napolitano, honorable judges and justices, and leading legal minds will and have been invited to speak,” Brooke Bialke, Bachmann’s deputy chief of staff, said in an e-mail. “Topics ranging from the commerce clause to the intersection of constitutional principles with daily concerns such as Medicare will be covered.”
Of the three “scholars” named, only Napolitano, a former New Jersey judge who hosts “Freedom Watch” on Fox Business News, is a lawyer. Hannity is a college dropout.
Bachmann’s endorsement of Sean Hannity as a constitutional scholar is self-evidently ridiculous, but the sad truth is that Hannity may be the least radical of Bachmann’s three proposed instructors.
So it’s clear that Bachmann has no interest whatsoever in teaching lawmakers about what’s actually in the Constitution. Napolitano and Barton are firm believers in the notion that the Constitution means whatever they want it to mean, but they clearly have no genuine expertise on the document. It’s unclear if Bachmann will be able to follow through on her plan, now that she has lost her bid for a spot on the GOP leadership.

During the October 7 program, the two agreed that Obama will "start a wider global war" to "be a prince," and discussed whether a powerful banking cartel linked to "world government" would "collapse the economy" and use that "as an excuse for martial law." Napolitano also told Jones of Texas secession: "That time has come. That may actually happen" because of the actions of the government.
Napolitano also discussed Glenn Beck, whose Fox News program he frequently guest hosts. Jones suggested that Beck picked up ideas from him, especially with regard to the "pants on fire" false smear that Obama administration official John Holdren has a plan of "forced sterilization in the water." Jones added that "Beck is now able to go on the air and talk about things that 15 years ago I was called a lunatic for."
Jones is widely viewed as the leader of the conspiracy theory that the 9-11 attacks were an inside job (the 9-11 Truth shirt pictured above is sold at Jones' online store). Jones is also a proponent of such conspiracies as a New World Order plot to exterminate 80 percent of the world's population, the Obama administration's "already happening" "plan to sterilize [the] population through water supply" and FEMA "death camps."
Still, that hasn't stopped Napolitano -- himself a frequent anti-government conspiracist -- from repeatedly appearing on Jones' program or hosting Jones on his Freedom Watch program when it was only airing on FoxNews.com. Napolitano, who announced yesterday that Freedom Watch would expand from the weekend to weekdays on Fox Business, is apparently such a fan of Jones that he promised to host him on the new program. Napolitano has also hosted truther Jesse Ventura, who was given an unchallenged platform to push 9-11 conspiracy theories.
Napolitano and Jones both admire one another. Napolitano has previously told Jones that "you, my friend, are doing more than anybody I know -- I'm trying to keep up with you to educate the public in the dangers of too much government. And guess what? The message is getting through, Alex." Napolitano also said of Jones: "Well, we go to places like your show because of your zeal and your courage and your fearlessness in exposing this. As much as you exercised the same zeal, and courage and fearlessness in the previous administration, and we have to educate people." In return, Jones said that Napolitano is "best person out there period on national television. In fact, he's the only person that I agree with almost 100%."
Jones and Napolitano "agree" that Obama will "start a wider global war" to "be a prince." After Jones said he was concerned officials would "start a wider global war as a pretext to have the empire expand," Napolitano said he agreed and claimed that Obama, like President Bush, wants "war because it lets them be a little prince. And every president that has waged a war has acted like a little prince." Listen:

Jones and Napolitano discuss secession, prospect of a powerful banking cartel collapsing the economy to institute "martial law."
During their discussion of the Federal Reserve, Jones stated that there is a "private banking cartel that is now openly announcing world government. It's either us or them and Ron Paul put out a video that's up on PrisonPlanet.com, we've got him on tomorrow by the way and I'm going to ask him about this, but he said basically what you just said. He said we're now at that critical juncture, or entering it, where either they're going to collapse the economy, use that as an excuse for martial law, or they've miscalculated and we're going to be able to get our country back. But regardless, we're entering waters that are extremely violent. The fireworks have just begun."
Napolitano replied that he, like Ron Paul, believes "two things are going to happen":
NAPOLITANO: The revolution, which we are in the early stages of, will first cause our empire to crumble. I mean, we simply will not be able to finance over 900 permanent military installations all around the globe. And those people will be free from our occupation. They will also be bereft of us spending cash there, but we'll have more cash to spend here at home. That's the first stage of the revolution.
Now, the second stage of the revolution, in his view and in mine, is sort of like what happened the Soviet Union fell. When the Soviet Union fell, the countries that it had occupied from before, during, and after World War II became free countries, and many of them became freer than the United States in terms of the engine of the free market, a truly free market, some with even a flat tax driving great prosperity and educating people in private schools, which you could afford to send your children to because your taxes were lower and people had more money to invest, et cetera.
That might result in things like Texas saying to Washington, D.C., stay the heck out. When we joined this country, our resolution, which was enacted by the Texas legislature and the congress, said we can leave whenever we want. Guess what? That time has come. That may actually happen.
Jones responded that New Hampshire also "has the right to revolt."

During the show, Jones asked Napolitano whether Napolitano has been "influencing" Glenn Beck because "he is getting more and more hardcore." Jones later suggested that Beck followed him on pushing the falsehood that John Holdren is in favor of "forced sterilization in the water" and added, "The mood of the country has changed if Judge Andrew Napolitano has the number one show on Fox Business and is getting a primetime show weekdays and Glenn Beck is now able to go on the air and talk about things that 15 years ago I was called a lunatic for, when all I was doing was reading their own statements."

JONES: Are you influencing Glenn, because he is getting more and more hardcore. Last night, we played a clip; earlier in the show, he talked about the Fabian socialists wanting to poison the water supply.
NAPOLITANO: I don't want to take credit for influencing him. I will to tell you this: we spend a lot of time together. We do a lot of speaking gigs together. When you travel with Glenn, you travel first class, so we're in a small, private jet. And we do a lot of talking. He has told me that I've changed his mind on two issues: one is the Patriot Act, and the other is the morality, lawfulness and constitutionality, or lack thereof, of torture. So I will only take credit for those two areas, which are profound. I did not hear what he said about the Fabian socialists, and I didn't hear what he said about poisoning the water supply until you told me because I was on another show last night when he said that.
But I'm not surprised that he said it. I'm happy that he's issuing those warnings, and Alex, those warnings are resonating with people. You've been saying this for years. Now, he's saying it. Between the two of you, that's a monstrous audience hearing these things.
JONES: Well, every day for two years, I have shown the quotes from Ecoscience, where Holdren said reduced population of planetary tyranny to do it. Forced sterilization through the water. Beck quoted Ecoscience word for word last night. He played George Bernard Shaw. I mean literally it's - and I've been critical of Beck on torture, and the police state and things he's supported, but - it shows one thing. The mood of the country has changed if Judge Andrew Napolitano has the number one show on Fox Business and is getting a primetime show weekdays and Glenn Beck is now able to go on the air and talk about things that 15 years ago I was called a lunatic for, when all I was doing was reading their own statements.
NAPOLITANO: Well, you have to add to that the - and I'm not just blowing smoke at you. You have to add to that the phenomenal success of your own show. People have awakened.
The U.S. government was behind the 9/11 attacks. Jones describes himself as being on "the front lines of the growing global information war from ground zero to the occult playgrounds of the power-mad elite. Jones predicted the attacks on September 11th, 2001 and is considered one of the very first founding fathers of the 9-11 Truth Movement." Jones' Infowars features a section for 9-11 conspiracy theories. Jones also sells "exclusive" movies dedicated to the 9-11 Truth movement:
9/11: The Road to Tyranny. The movie claims to document "the ruthless history of governments orchestrating terrorist attacks against their own people to scare them into total submission." The description continues: "In this brutal expose you will witness the birth of a global police state that surpasses Orwell's nightmarish vision. It's all here: *The history of government-sponsored terrorism *The modern implementation of fear-based control *The New World Order's future plans."
Truth Rising: The 9/11 Chronicles Part One. The movie description states: "Join Alex Jones, Luke Rudkowski and others as they set out on a mission determined to expose the ruthless global elite and alert the masses to the truth about 9/11. Strap in and get ready to ride along as criminal overlords David Rockefeller, Zbigniew Brzezinski, Bill and Hillary Clinton, Alan Greenspan, John McCain, and many others are confronted about their lies and manipulation."
Jones is the executive producer for Loose Change: Final Cut and helped with "financing the production and release of the film." The movie states that it "hopes to be the catalyst for a new independent investigation, in which the family members receive answers to their questions, and the TRUE PERPETRATORS of this horrendous crime are PROSECUTED and PUNISHED." TIMEnotes that Loose Change is "[o]ne of the most popular conspiracy videos online, ... a 90-min. blizzard of statistics, photographs, documents, eyewitness accounts and expert testimony set to a trippy hip-hop backbeat. It's designed to pick apart, point by point, the conventional narrative of what happened on Sept. 11, 2001."
One world government / New World Order is in "final" stages for authoritarian rule. Jones' film Fall of the Republic documents how the New World Order dictatorship is in the "final stages of completion" for an authoritarian world government:
